1. The seller
The seller is Hopelle S.r.l., a Società a responsabilità limitata (S.r.l.) under Italian law, with registered office at Via dei Glicini 12, 20144 Milano, Italy, registered with the Registro delle Imprese di Milano under REA MI - 2587419, VAT number IT12894570968 (the “Seller”).
2. Scope
These GTCS apply to any contract concluded between the Seller and any natural person acting for purposes that fall outside their trade, business, craft or profession (a “Consumer”) through the website hopelle.shop (the “Site”). They prevail over any other terms unless expressly accepted in writing by the Seller.
3. Products
Hopelle currently offers a single product: the Hopelle Bunny Harness & Leash Set. Photographs and descriptions are provided in good faith. Slight variations in colour rendering, fabric weave or stitching may occur and do not constitute a defect.
The product is currently sold out. Customers may join the waitlist to be notified when stock returns. Joining the waitlist does not constitute a purchase, a reservation or any commitment by the Seller to deliver the product on a specific date.
4. Orders
Orders are placed electronically through the Site. The contract of sale is formed when the Seller sends the order confirmation by email. The Seller reserves the right to refuse or cancel any order in case of suspected fraud, payment failure, abnormal quantity or stock-out.
5. Prices
Prices are displayed in euros (€), inclusive of Italian VAT (IVA) where applicable, and exclusive of shipping. The price applicable to an order is the one displayed on the Site at the moment the order is validated. Shipping costs are shown before checkout is completed.
6. Payment
Payment is due in full at the time of order. Accepted payment methods are listed at checkout. Card payments are processed by a PCI-DSS compliant payment service provider; the Seller does not store full card numbers on its servers.
7. Delivery
Detailed delivery terms, lead times and shipping costs are set out in our Shipping policy. Risk of loss passes to the Consumer upon physical delivery of the product.
8. Right of withdrawal
In accordance with the Italian Consumer Code (Codice del Consumo, D.Lgs. 206/2005, Articles 52 et seq.) and Directive 2011/83/EU on consumer rights, the Consumer has a right to withdraw from the contract within fourteen (14) calendar days of receipt of the product, without giving any reason and without incurring any cost other than the return shipping cost.
To exercise this right, the Consumer must inform the Seller of their decision before expiry of the withdrawal period by an unambiguous statement sent to support@hopelle.shop. The full procedure is set out in our Returns policy.
9. Legal warranty of conformity
The Consumer benefits from the legal warranty of conformity (Articles 128 et seq. of the Italian Consumer Code) and the warranty against hidden defects (Articles 1490 et seq. of the Italian Civil Code). The Seller will repair, replace or refund any non-conforming product reported within the legal warranty period, free of charge to the Consumer.
10. Responsible use
The Hopelle harness is intended for short, supervised outdoor moments only. It is the customer’s responsibility to introduce the harness gradually and to never leave a rabbit unattended while wearing it. The Seller declines any responsibility for damage, injury or escape resulting from misuse or unsupervised use of the product.
11. Liability
The Seller’s liability is limited to direct, foreseeable damage proven by the Consumer, up to the amount paid for the product concerned. Nothing in these GTCS limits the Seller’s liability for death, personal injury caused by negligence, fraud or any liability which cannot be excluded under Italian law.
12. Personal data
The processing of personal data carried out by the Seller is described in our Privacy policy.
13. Applicable law and jurisdiction
These GTCS are governed by Italian law. Any dispute that cannot be settled amicably falls under the exclusive jurisdiction of the competent courts of Milan, Italy, without prejudice to any mandatory rule granting the Consumer the right to bring proceedings before the courts of their place of residence.
14. Online dispute resolution
Pursuant to Regulation (EU) 524/2013, the European Commission provides an online dispute resolution platform accessible at ec.europa.eu/consumers/odr.
